Abstract

The short answer to the question posed in the title is no. The Fourth Amendment is not obsolete because the core values it seeks to protect are still important to a free society. The better question and the one this article addresses is whether or not current Fourth Amendment doctrine adequately protects individual privacy in the face of sophisticated and advancing surveillance and detection technology.
